Periodic Tenancy
A landlord or tenant must give a minimum period of notice when ending a periodic tenancy.
A tenant must give at least 21 days’ written notice to end the tenancy, unless the landlord agrees to a shorter time (it’s best for this agreement to be in writing). The landlord can end the tenancy by giving 90 days notice (no reason required), or 42 days notice if the owner or their family are moving into the property, or it is sold and vacant possession is required.
If a landlord gives the tenant notice to end the tenancy and the tenant wants to move out sooner, the tenant must still give the landlord 21 days' written notice. If there are multiple tenants named on the tenancy agreement, and one or any of the tenants give the landlord notice to end the tenancy, this ends the tenancy for all of them.

Fixed Term Tenancy
Legally you cannot end a fixed-term tenancy early. Tenancies can only be changed if the landlord and all the tenants (everyone named on the tenancy agreement) agree. So if either party wants to end the fixed-term early, they can approach the others to see if they’ll agree. Any agreement should be in writing, clearly stating what’s been agreed to, and each party should keep a copy.
You will have to pay an advertising fee and an administration fee to help find new tenants for the house and you are liable for the rent until new tenants can be found. You must also work with us in showing the property to prospective tenants.

- Process of Ending a Fixed term tenancy -
- We require written notification of the date you wish to end the tenancy and a payment to cover advertising and administration expenses.
- We will not start marketing the property or sign a new tenancy agreement without written notification and payment of the break fee.
- You are not allowed to break your tenancy during the winter months (Jun~Aug) or the Christmas months (Dec).
- We need at least 5 weeks to market your property.
- Once we have signed a new Tenancy and received a deposit from the new tenants, you will be notified in writing of the date we will release you from your tenancy.
